My cell phone is damage

It's been 4 months that the phone supposed to be replaced. The form was filled out 3 times. But surion kept stalling until they changed their policy to they will make people pay for a replacement even though the phone is fully insured at 17.99 a month. They need to replace his note pad s20 without any charge
