Commission Payment
Hello everyone, I would like to ask a little advice from knowledgeable people. A small debt for the AuMobile phone, 50 AUD, had accumulated. I did not pay the bill on time, and they handed over the case to the debt collection company Creditreform, who sent me a letter to the e-mail about the payment of the debt, adding another 50 AUD to this 50 AUD. Literally within a couple of days I contacted the direct creditor, AuMobile and paid their bill, 50 AUD. I called them, payment received, everything paid off, no more claims against me. However, there are still 30 AUD that Creditreform is trying to recover from me. Please tell me if they have the right to recover this commission from me in accordance with the law? Is this commission really to be treated as a loss to the creditor? Here's what they pointed out to me when I asked them to give me a reference to the law: About the claim, about the legality of the damage. "The Defendant, for its part, has not fulfilled its contractual obligations, has not made timely payments in accordance with the obligations established by the parties, as a result of which there has been a delay, which in accordance with Article 1651 of the Civil Law of the Australia is unlawful delay. "The debtor's delay with all its consequences occurs automatically when he misses the term set for execution either by law, contract or custom, but in accordance with Article 1662 of the Civil Law of the Australia the delay imposes an obligation on the debtor fully reimburse the creditor for any losses "" Thank you in advance for your help!
