Fraud and breach of contract

1

We received multiple advertisements emails requesting for us to apply for semi truck. So we decided to give it a try. Our worst mistake ever. We submitted application for financing back in early September. We received pre-approval offer soon there after. We submitted all requested documents that Ryder and the lender. We received contract and loan agreements. After we submitted down payment our Sales Representative went MIA. We finally got someone on the phone after calling a week to see when will the truck be delivered. Our sales Representative said we never discussed delivery which was not true, and the communication went down hill fast after that. He sent us estimates to have the truck delivered which started out as $3800 for a delivery date time line between 7-10 days. Now keep in my we need this truck to make money. We told him that's unacceptable. Then he came back with an estimate of $4100 for 2-3 days. Now we are pissed. So we said we would fly out and pick truck and trailer up. Which is in 2 different states. Well thats when the trouble began. Flew out from Texas to Denver only to have exceeded DOT standards truck to be inoperable. That's right, now its Friday and can't get anyone on the phone from Ryder. But Ryder location in Denver has repair shop and was trying fix the problem. They said they had no idea what the problem was and that they a running in circles. So now we are stuck in Denver until Monday at this point because the Ryder office is closed over the weekend. Finally got someone on the phone Monday evening, who sent information to our warranty company, which should not have happened because it should be covered under their 30 warranty. On to the next day with no word from Ryder, we are doing all the calling to them at this point) the lender called and told us that Ryder told them some fraudulent information to secure the loan and the lender said they are worried about the truck not working. So now the lender are not honoring the loan and told us to leave truck there. Now keep in mind we have to submit a business plan to the lender. And now Ryder is saying we lied to them about our business. I told Ryder I have a copy of every document and every email with extensive conversations with them and the lender. And did not lie to anyone. Ryder will not give me my downpayment and reimburse me for our expensees. This entire situation is a travesty. And guess what during this process we found out the sales Representative no longer work for Ryder as that Friday we was in Denver. Now we are lossing money from our new business because we do not have our equipment and my husband lost money from our other business for being in Denver from Thursday until Wednesday morning dealing with this. But some how according to Ryder this is our fault. Someone misrepresented our business from Ryder (if) they told false information to the lender. I don't know if the lender is just saying that to get out of the contract agreement at this put. But at the point that really doesn't matter, because we submitted a business plan in reference to our business in its entirety. We signed the contract, promissory note and the lender released the funds. To add insult to injury, Ryder said to me they don't care about me they just want to make sure their relationship in tac with the lender. So you don't care that you treated a customer like this. In all of this mess truck was inoperable, lender backed out of it's agreement and I was insulted repeatedly. And this does not include all the money we lost. We just devastated.
