RTN ROOFING SYSTEMS poor workmanship, bait and switch

I'm writing this on behalf of a client who was not only ripped off on a repair by this company by not following written instructions (see inserted redacted [for privacy] copy below), but in an attempt to save his company's reputation, blamed his staff's bad habits and shortcomings on the salesperson. This happened many times with Jeffery and Joel Lozon; each case will be aired in the public forum, protected by the First Amendment, until such time as they compensate both me and my client for what essentially is theft. The first document was requested by Jeffery Lozon himself, because his production manager really runs the company and was throwing a hissy fit because the company hired professional salespeople instead of promoting him (ample documentation of the "good ol' boy" gang at this company is in my possession, along with Joel Lozon's feeble attempt at encouraging 'team work.' 6/18/13 T**** B****** Residence **52 ****** Drive Golden , CO ***** Line Item Bid for repairs based on Xactimate pricing estimates (my account is inactive but I can get close approximate prices on this simple repair). Tear Off and Dispose 1.8 sq @ $52.00 per sq = $93.60 Install 40 year shingles 2 sq @ $250 per sq = $500.00 Two Story Off 1.1 sq @ $15 = $16.50 Two Story on 1.1 sq @ $25 = $27.50 R & R White Drip Edge/Gutter apron 2 x 4 / 60 LF @ $2.40 LF = $144.00 Install Ice and water shield entire surfaces/180 sq ft x $2.30 SF = $414.00 D & R gutters to install new drip edge / 21 LF x $2.50 LF = $52.50 Pickup truck load disposal fee = $128.00 Roofer Base Service Charge/Labor minimum = $285.00 Travel surcharge (Fuel expense outside normal repair area) = $38.90 (Owner will remove and replace Satellite dish) Total $1700 (no permit required for repairs; Mr. B*** negotiated $1700 even with me by offering to take care of the dish, and I accepted. I basically just added in the difference as “Travel Surcharge” –could be materials tax- I hope this works) Apparently, this was not enough information for the "highly skilled' RTN staff. . . Now they wanted a complete written Scope Of Work (on a simple, small repair! They already had ample informative entries and photos downloaded into their lame, partly operable CRM. 6/21/13 T*** B****** Scope of Repairs Summary: The roof is approximately 10 year old 40 year/lifetime Tamko Dimensional Shingles. The concern is the roof leaking on the low pitch dormers north elevation. The shingles are in good condition; the leaking is suspected due to failing or inadequate underlayment. The upper slope is a solid 2/12 and not less, thus we can install shingles under materials warranty, but we will have to cover the entire area with Ice and Water Shield underlayment. We will include it on the lower slope as well, even if it is steeper. It will eliminate any potential problems. Scope of work will include: Call ahead to schedule with property owner—he wishes to be there. Detach gutters and set aside carefully. Tear off and disposal of shingles, drip edge, and underlayments to deck, inspect decking (since the leak is recent we do not suspect rotten decking*). Install Ice and Water Shield on entire upper and lower slopes, extending up into the upper slope transition to ensure a code compliant repair. Install 2 x 4 new drip edge (not D Edge) on rakes and eaves. We have have to special order shingles but at last check online the Forest Shadow 40 year shingles were still available. We however, must reserve the right to substitute a similar quality Tamko if they are not available. Install new shingles, Reattach gutters, clean up and haul away all debris. *Any unforeseen circumstances will be addressed on a Time and Materials Basis. Any insulation, mitigation, interior repair work, and detaching and resetting the Satellite Dish is the responsibility of property owner (you'll need to call your provider to have them realign the system, setting the appointment ahead of time, and there may be a charge for that, not included). We have also discussed ‘leaking siding;’ property owner will address after roof repairs are completed. FYI -- Our prenegotiated Deal: Total Cost: $1734.50, includes everything but permit (not usually required on repairs, if it is we'll cover it). I'll suggest $1700 even to the boss if we can do the work with other projects in the area. No projects, but always a great, common sense negotiating tool working distances. So even with all this the Production staff first orders and installs the cheapest Tamkos they can find (normally one reverts to the next reasonable alternative, ESPECIALLY when thickness and profile are a consideration. Using such a cheap disparate shingle to repair a high end roof is nothing short of a cheap riopoff, especially when one reviews the submitted documents above. Then, his lazy production staff cuts out new drip edge and installs it over old drip edge; first, he was sold gutter detach and reset, which they failed to do but kept the money; second, why would you tear off all the shingle to the deck and install a double drip edge? Violates code and is extremely shoddy workmanship--basically a unsupervised rip off. On top of this, Jeff Lozon blames me in writing to the client to get himself and his employees out of reponsiblity and trouble. Jeff Lozon has done this to several other customers he screwed up shceduling and contact with. This is why he is facing a lawsuit for defamation of character, which due to witnesses and a paper trail will not be too difficult to prove.
