Reservation refund

February 22, 2008 Thank you for this service. I do not believe the following is a fair or legal charge. On the date in question, (November 26, 2007), I made reservations at the Lexington hotel from my home. I live approximately a 4 hour drive from the motel and made the reservations based on information from the internet. I drove to the motel directly after making the reservations. Upon arrival at the motel, my wife and I observed that the establishment appeared to be a bit seedy, we also observed guys sitting on the walkway outside their room drinking bottles of beer. I did not feel comfortable bringing my wife there and staying in this particular area of the town. I parked and went to the motel desk. I told the woman behind the counter that I had reservations but elected not to stay there. I told her this was not what we expected and my wife preferred not to stay there. The woman behind the counter told me that I would have to pay for one night because I did not cancel prior to 7 hours. I told the woman that I had only made the reservation 6 hours ago. The woman then basically told me too bad, the manager was hard over on this policy and there would be no exceptions. Rather than get in an argument with the woman, I simply thanked her for her time and left. I contacted Advanta (my credit card company) and was told to wait and see if they tried to charge my account. When the charge did appear on the card I started the dispute process. The faxed response from the motel that I “neither cancelled nor showed” up is wrong. If you check my Advanta account call record you will see that I called November 26th regarding about this injustice. It is obvious that I would have had to been at the motel and talked with someone. At no time during the reservation process was I informed of a no refund policy. It is obvious to me that others have found the establishment not to their standards and elected to go elsewhere. I also question how reputable it is to not present such an iron clad policy to the customer. Not only was I not informed on the telephone, there is nothing I could fine online regarding any policy. I consider this the same as walking into a store, not finding what you want, and then be charged because their policy is you have to buy something. There is NO protection for the customer regardless of what is involved, including concern for one’s safety and security. Again thank you for your intervention and I look forward to the decision.
