DENYING MY CHILD COURT ORDERED CARE

Update by user Nov 13, 2019 On November the 8th my son's psychologist sent a referral to TennCare stating that my son is a danger to himself and others and should be in long term residential care. He further states that my son's behavior is now to a point that he feels he could become the next mass shooter. My son is 11 years old. Had he not been denied treatment for the past 3 years by Youth Villages and TennCare maybe he would have gotten better and not worse. Update by user Nov 13, 2019 UPDATEMy son was forced out (stated cured and sent home under much resistance on my part and the part of his real doctors). I was told to pick him up or they would turn him over to DCS custody. That was August 5th. By August 5th my son had ran away from school, cussed out the police officers that found him, cussed his teachers, stole from other students and his teacher. He was placed on 6 months probation which he violated by sexual misconduct with several students in his class and a group of pre k children. He, on September 5th, exactly one month of being "cured" by Youth Villages, was placed on house arrest which will remain until late February if he does not violate that. My son has been taken to the emergency room in crisis on more than one occasion since his dismissal from Youth Villages Bartlett Campus. He remains suicidal and homicidal and has great ideations of killing me and has attempted to do so more than once. When taken to ER in mental health crisis the protocol is to bring in a crisis counselor from Youth Villages Crisis Management Team. Every time my son has been in crisis since being released from YV Bartlett the crisis counselor has denied him admittance to any type of care facility. The last time a crisis counselor was called she told me that her supervisor, Megan from Youth Villages, had phoned her on her way to the hospital and said that they would not be re admitting him into residential care. This counselor had not spoken to or seen my son or myself at this point. She made a predetermined decision to send him home. I will try to attach a picture of what my son looked like when we arrived home. You can see he is very much in crisis and needs help. Update by user May 15, 2019 I have added a copy of the court order dated March 20, 2017 as well as a letter from TennCare dated April 19, 2017. The Court order demands a higher level of care for my son. The letter from TennCare states that they are working together with Youth Villages to circumvent the court order and find a lower lever of care for my son. Also attached is the follow up notice from TennCare on September 22, 2017 stating that Dr. Tom, psychiatrist for Youth Villages, has decided to stop my son's care. Another blatant disregard for the court order by Youth Villages. I have been fighting these entities for 2 1/2 years to force compliance of this court order. I have had the assistance of Tennessee Justice Center to assist in this since very early on. They, TJC, made a deal with TennCare that because they refuse to follow the court order that we would agree to have my son evaluated by the Center of Excellence and follow their recommendations. It took nine months to get this evaluation due to Youth Villages missing appointments. Now we have recommendations and both Youth Villages and TennCare refuse to follow them. A few days ago I was told by the Tennessee Justice Center that we can no longer cause them to follow the court order or the agreement we made in lieu of the court order because so much time has lapsed. Now Youth Villages , TennCare and the COE are trying to send my son home without even providing transitional services (which is provided to all children that have been in RTC for over a few moths time). He has been there for 2 1/2 years. Original review posted by user May 14, 2019 My son has been diagnosed with several mental illnesses including Anti Social Personality Disorder, Disregulative Mood Disorder, Bi-Polar Disorder and a few others. He has bee placed in Residential Treatment Facilities eight times and has come home without change. These treatment centers are glorified babysitter that fill children with as much medication that they can get away with and then send the children back home only to continually repeat this process. I fought the insurance company to get my son into a genuine psychiatric facility so that he could get the treatment that he very desperately needs. We won the court hearing. Even TennCare's own witness, a psychiatrist, stated that my son needed a higher level of care in an inpatient psychiatric facility that offers neuropsychiatric care. That was 2 years ago. My son has still not received the care as set forth in the court order. TennCare and all involved have refused to follow the judges orders and there is no one that I can find to fore them to. My son was 8 when he killed a litter of kittens to get back at me for making him go to be early. He has on numerous occasions attacked me physically, once he even broke my hand. The worst in my opinion was when he plotted out a way to kill my 7, 5 and 2 year old grandchildren. He was upset because they were able to play and he had to finish his school work. He hid his pencil so that he could "stab them and kill them when everyone went to sleep". Now, after 2 years in Youth Villages residential treatment he is being sent home again. He is the same as when he left here. I was told that as part of his returning safety plan that I need to lock up everything sharp due to his homicidal ideations. I have to have eyes on him 100% of the time. Does this sound like a child that is safe to return home? During this past two years I have taken my son to private psychologists that have agreed with the treatment plan as set by the psychiatrist in the court hearing and yet TennCare has decided that the determination of low level counselor is of more value.
