Wireless headphones broke in three weeks

I bought this product as a backup for when I'm at home, I move around a lot at home, so I figured these headphones would be perfect. Well, I was wrong, the headphones does not stay in my ear. Family and friends complain that they can't hear me when I wear them. Three weeks of having them and the left headphone falls out of my ear and breaks. I tried contacting Best Buy and no luck since I didn't purchase the protection plan. I tried calling the warranty company and operations are closed on the weekend. I need someone to contact me in regard to getting a refund and/or replacement.
