Major defects

We had a new Dacor cook top installed on 3/31/08 with five known major defects. The installer, recommended by CBD Family Appliances(CBD), contacted CBD and they allowed the istallation to proceed. CBD told us the cook top needed to be evaluated first and told us to contact them and the evaluation was completed on April 3. They confirmed that one burner linkage did not connect to anything, two other burners were defective, the grate wobbled, and the top was bent. On April 4 we went to CBD and they said we should get a new cooktop after the paper work was received from the service company. They assured us this would not be an issue Dacor about getting a new replacement. We followed up and on April 10 were informed the cooktop would be repaired, not replaced, because Dacor said they are only responsible for replacement if the product is not installed. Dacor's installation instructions (copy available) received with the appliance do not warn the consumer of Dacor's claimed lack of responsibility to replace a cooktop with major defects. CBD has now offered to repair, not replace because they said Dacor is responsible. We purchased from CBD, not Dacor. Neither one is taking responsibility for a product with at least 5 known major defects. At present 75% of the burners do not work, or work properly. We did not pay for a used or repaired appliance, we wanted and paid for a new, defect free appliance.
