We hired Albert Flores DBA Ovation Construction Company in March of 2018 to complete a Private School Project for our Organization, AML Council in Kissimmee Florida. The Contract states that the work will be completed in 60 days so we can have our private school open in August of 2018. The contract value was $319,000 We were immediately alarmed when ONLY TWO EMPLOYEES SHOWED UP TO WORK ON A $319,000 Project, and Albert response was the rest of the crew is coming. We later found out that he uses the DBA Ovation, therefore, when you check the records you are fooled to believe that he is Ovation GC, who conducted much work for Government, Churches, and Private Sectors, only to find out that Albert WORKED FOR OVATION in the past, and now uses the DBA Ovation. Within the first 30 Days, Albert Raised the price $59,000 for "Trees he found under the Ground shifting the Blame on the civil engineer and the survey company. Although the contract agreement states that the price change shall NOT BE MORE THAN ONE PERCENT, we accepted for the Sake of a School for Pre-K to 8th grade we are trying to open within months and accepted the change order the first time, only to have him try to do the same things twice after that for almost another $90K and we rejected. Allbert Demand for weekly payments continues, only to find out later, that we were paying for items that were NOT EVEN TOUCHED, such as "Fire Hydrant Install, $30 plus thousands, then Walk WAY Material $40 plus thousand:. Then 2 months went by, and the contract states that the work is to be in March 16th, 2018 and to finish NO LATER THAN JUNE 15th due to an application that must be submitted to the County for inspection, and then the State. When we passed June 15th, and we lost the ability to file for the School License, another Month has passed, be now it was almost August 11th, and Albert Flores "Next Week Stories" were becoming more alarming to our community, more specifically, when he received almost $275,000 (almost 70-75%) of the contract amount, and according to 3 other General Electricians, Plus THE COUNTY inspector stated that not even 10% of the work has been done, NO Permits were filed with the County, the material submitted to TOHO Water Authority was NOT COMPLETED, and we MADE A HUGE MISTAKE on placing the Pips in the Ground without prior notifications to A) Civil Engineer on the Project, in which he should have submitted the material that will be used then, purchase after the Civil Engineer approval B) The Material used should have been submitted to the Water Authority, and it was not Furthermore, we experienced MAJOR WATER BACK UP IN INSIDE OUR COMMUNITY CENTER DURING PRAYER SERVICE, only to find out thru the Cameras, and Albert Flores Own Admission that one of his employees caused Damage to the existing water closeouts that caused the water back up inside the center, and we had almost 3 inches of water inside the center with damages well over $90,000 We contacted the Media and scheduled a press release to inform the parents of the students who were registered and expected to have their kids attend our private school for the academic year of 2018-19 that we will not be able to open, and to begin searching for an alternative schooling for their kids attend (this was about beginning of August, which was ONLY DAYS AWAY FROM THE FIRST DAY OF SCHOOL IN OSCEOLA COUNTY), many were broken-hearted and no words can describe their disappointment. When Albert Flores was contacted by several reports from Various news outlets he promised to finish the work and honor the contract. To our mistake (Again), we canceled the press conference scheduled to give him another chance only to have him send ONE EMPLOYEE every other day for few hours a Day pretending to work When Albert demanded MORE FUNDS, although he was paid almost 80% by now of his contract, and only aprox 10% of the work is completed we terminated the contract. We were informed a few days ago by our Attorney, that both of the INSURANCE CERTIFICATES provided by ALBERT FLORES WERE FRAUDULENT, and she confirmed that BOTH insurance companies ALBERT FLORES PROVIDED stated that HE NEVER HAD ANY COVERAGE At this point, we have filed complaints with the State of Florida Office of Professional and Business Services demanding an investigation, we have sent a request to our State Senator Santro office, Florida House Rep. John Cortez and the District Attorney's office to investigate the Allegation of Insurance Fraud, as well as damages Albert Florida/DBA Ovation Construction estimated between $100-150K with of damages inside and outside, as well as seeking a refund for the (aprox) $280k Albert Flores has received from our NON Profit organization that was the donations from family and community members who ALL WORKED SO HARD TO SEE THE FIRST private Academy for our community in Osceola County open, in instances, we know of a couple who sold their wedding rings, others who sold their houses, and some worked double shifts to pay Albert Flores weekly demand for funds, only to be left with damages, liens on our property, a financial loss of almost $350,000, and THREE General Contractors stated it will cost $400,000 to finish the school project!!!
