Under handed dealings

3

I was searching for a vehicle. I searched online and found a 2017 Nissan Maxima at Auffenberg Hyundai that I was interested in so I called and made an appointment to look and test drive it. I already had secured financing before I got there. After the test drive, I decided to do the dealership application that would be submitted directly to my lender. The Sales guy came back but showed me nothing in writing and said that my lender said "they would not finance me without putting thousands of dollars down and not just a couple of thousands" and he suggested that I go with something brand new with a rebate. He suggested this because I was indeed trading in a 2013 Chevy Camaro and had some negative equity going in. He then proceeded to suggest that I purchase a new Hyundai. I told him several times that I was not interested. He continued to ask me why and would I consider test driving one. I repeated several times that I was not interested in driving a Hyundai. He then asked me if I would consider a Nissan. I told him I would. He asked me if I knew where the Auffenberg Nissan dealership was and I did not so he agreed to take me to it. After we arrived at the Nissan dealership, he met with a salesman there and introduced him to me. The Nissan salesman started right off telling me that he could not get me into a Nissan Maxima due to it being a higher priced car and that I needed to go with an Altima. I told him that I was not really interested in the Altima but he was very persistent and kept telling me that it was a sport version of the Altima and that it had a good rebate that would allow me to get into a new car and out of my Camaro. I told the Nissan salesman from the very beginning that I needed a car with a remote start. He assured me that they could put one on it. I complained about the car not having Sirius XM radio as well as a Navigation but he tried to smooth that over by telling me what alternatives I could use to get those amenities. I saw that the price of the car being on the windshield at $21,4XX and I assumed that I was getting the car for that price. It was not until the meeting with the finance manager that I realized that the price was not what was on the windshield but they tried to explain that after all the rebates and etc. that I was still getting it for that price. Meanwhile, why they were working the numbers on the Altima, they were shopping my credit around to other lenders even after I asked them not to because I had secured financing. I later found out the reason for that was because they had the car priced more than what my lender had approved me for. After signing the contract that included a "No Cooling Off Period", I felt very uneasy about the transaction, After 3 days, I consulted with a finance manager from another dealership out of state and he advised me that it was a very bad deal and that I needed to return the car. I told him that the contract had a "No Cooling Off Period" clause, he said if they didn't have the check from my lender that they hadn't secured financing yet. I called my lender and told them that I thought something was off about the deal and told them I was not happy. They informed me that if I was not happy that they would not issue a check for the transaction unless I was completely satisfied. I spoke to my sales person as well as the sales manager and told them of my concerns, they said that I had to keep the car and that there was a no-return policy with their dealership. I knew that they had not received financing yet from my lender so I returned the car 3 days later. I asked for my trade in back but they would not give it to me. Now I have no vehicle at all and have not heard from Auffenberg Nissan on a possible solution to this problem. I was coerced into getting the Altima because it was more money to be made by the newer car purchased. I was told by my lender that the conversation was recorded and that I could have very well got into the Nissan Maxima from Auffenberg Hyundai. The salesman was told that they were asking too much for the car and that they needed to drop the price of the car about $2500-3000 to get me in it. That salesman never showed me any paperwork on the numbers, he just walked in and said it couldn't be done and I needed to purchase a brand new vehicle in order to make the deal happen. They lied to me and I am not very happy about it at all. Now I have had to call my attorney to get him involved. I'm not sure of what is going to take place at this point but I would advise anyone to not do business with Auffenberg Dealer Group at all for any of their vehicle purchases. They have more bad review on "Yelp"
