No refund!!!

I ordered flowers for a birthday, he wrote me said they couldn't deliver it the day I wanted and it would be delivered the next day. Well he said he tried to call me which he didn't because my phone is always with me. He said he couldn't get in touch with his affiliate and that they would refund my $74.88. I never received it and he told me "the account is closed and a refund was issued and there is nothing else to be done". Well I looked him up on BBB and he's had over 400 complaints, why is he still in business? He is stealing from people.
