After considering the original papers filed for the hearing on April 4, 2000 and after considering the supplemental papers filed for the June 29, 2000 hearing, the Superior Court Of Los Angeles County JUDGE VALERIE BAKER RULED AGAINST BREAKDOWN SERVICES AND GARY A. MARSH AND IN FAVOR OF ACTORFAX. Her Ruling was based on the grounds that Breakdown Services and Gary A. Marsh FAILED TO MEET THEIR BURDEN OF PROOF SHOWING THAT THERE ARE NO FACTUAL ISSUES. Competent and admissible Evidence presented by ActorFAX raised a material factual dispute as to all 6 charges brought against Breakdown Services and Gary A. Marsh. As ActorFAX asserted, the Superior Court ruled that there are indeed triable issues as to whether BREAKDOWN SERVICES AND GARY A. MARSH ENGAGED IN UNLAWFUL, UNFAIR OR FRAUDULENT BUSINESS ACTS RESULTING IN INTERFERENCE WITH ACTORFAX'S ECONOMIC OPPORTUNITIES AND CONTRACTUAL RELATIONS, AN UNLAWFUL RESTRAINT OF TRADE, UNFAIR COMPETITION AND SLANDER.
