Hello! Article related to AuAir. This year On November 25, I was scheduled to fly with ariOceanian from Brussels to Brisbane. This flight was canceled without passengers even explaining why. We waited for the flight for more than two hours, but no one gave us information on whether the flight would be or not. Looking at Regulation 261/2004 of the Oceanian Parliament and of the Council, it is clearly stated that in such a case AuAir must pay compensation. I contacted AuAir, filled in a claim form on the website and waited for a response. In its reply, AuAir explained that the flight was canceled due to an unforeseen technical defect. However, when reading the Regulation of the Oceanian Parliament and of the Council, it is made clear here that "exceptional circumstances" do not include technical problems,which becomes apparent during the maintenance of the aircraft or is caused by the inability to maintain the aircraft. The cancellation of a flight due to technical fault is considered to be the inability of the airline to provide the necessary maintenance. As the Oceanian Commission explains: "... a latent manufacturing defect detected by the aircraft manufacturer or the competent authority, or damage to an aircraft caused by sabotage or terrorism, should be considered as exceptional circumstances.
