Destroyed my frames and tried to charge me to fix it

AMOUNT DUE $127.00 USD refund This is my FINAL ATTEMPT TO COLLECT A REFUND Dear Andrew Bilinsky: You currently owe me a refund for the dollar amount of $127.00 for what has been nothing short of a disaster. I placed my original order on September 5, 2020, after extensive confirmation that you could work with these frames. The frames are EDGE TSKAP218. You can easily find them even on Amazon. Here is the homepage: https://edgeeyewear.com/, as you can see from the website: they are impact and ballistic tested and certified, as well as OSHA certified for safety. This is all due to the specifications that are, and were, in place when I sent them to you. I am a high reach forklift operator. Most people dont know what they do, but thats okay, A very simple explanation is we take loaded pallets out of the steel racks in a warehouse, at approximately 50 feet in the air. Now I have lost my job due to the irresponsibility, and complete lack of compassion from Lensabl, nor ethical practice in following through with what they claim they can do. The order number for the original order was as follows: 10006****, and as previously mentioned, was placed on September 5, 2020. They were a simple, standard, single-vision prescription, that I was making into sunglasses. They were standard AR, poly, polarized lenses. I also purchased a protection plan, because as I mentioned a few lines above this one, I work in a warehouse. Well, when I received these glasses back, which I was quite excited to get backwell lets just say that underwhelmed is the most politically correct that I can be at this moment. I will include pictures of these overstretched frames, and how they got scratched in the first place. I noticed they were not fitting on my face properly as soon as I put them on. So, I happened to have a non-destroyed, still original pair, of these glasses, so to test my theory I popped the lenses out, as they are meant to do in these frames, but could not under any circumstances get them into their unmolested sister pair of the exact same model number. So, they got scratched. I admit that. But Lensabl also admits that they were in the wrong and erred in the completely undeniable warp and stretch job that was done to the frames that were sent to your lab. I reached out for the first time, well my fiancée did, she has a better way with words than I do. Anyway, she reached out on November 2, 2020, the day I received them or the day after. She requested that the warranty be utilized. The customer service representative, Alex, asked for photographic evidence. So, we sent that over. This is the same picture that we used: Alex pretty much passed the complaint off as a boohoo too bad for you attitude. I will include the exact letter and evidence of the problem that I sent that caused the claim to be escalated: I placed an order for some lenses to be cut for my OSHA certified frames and have them sent to you to make my lenses. What I received back, is unacceptable and unsatisfactory. As you can see from the attachments, the frames have been stretched beyond wear, and the lenses are cut too big for the frames. If the lenses were cut to the frames I sent to you, they would be interchangeable with the secondary frames I have here that are the exact same size. There is no excuse for my glasses to be stretched beyond wearability, further I was basically told to go *** myself by one of your customer service representatives on Facebook. All Im asking for is that you guys replace the left lens that is scratched when I attempted to fix the problem that was mailed back to me by Lensabl. Further, if replacing the lens is unattainable, I will gladly take $40 in order to purchase a new set of frames and I will take my business elsewhere. I am not looking to seek legal action, nor am I looking for ways to waste the rest of my unemployment time due to Covid by trying to figure out a way to have you guys investigated for fraud. Ultimately the error is on you and your company and whoever manufactured these lenses. Are you urgently await your response to this very pressing problem. I attempted multiple strategies here at home, to fix the issue. However, I am not an optician, and therefore I should not be doing the job I paid you guys to do. The frames on the inside and the following pictures are the ones that I originally sent to you same make same model. The ones I received back or on the outside and as you can see they are significantly enlarged and overstretched from where Lensabl made lenses and put them in these glasses. I can gladly remove the lenses your firm installed and show you the very same lenses that were sent with my glasses as well as show you them inside of the box I sent to you initially when I begin the transaction. Those two sunglasses are the exact same thing minus one is having prescription lenses cut for one I check the lenses, that your lenses replaced, and theyre the exact same size as the counterpart so its like this I bought A lens protection package that seems easy enough when youre charging me for it however yall destroyed my glasses and the structural integrity which I dont understand because they are OSHA approved safety glasses essentially what Im trying to say is I feel for my inconvenience and troubles your company should honor the left lane like I said I will gladly remove them and clearly show you in video NHD but the ones you made were slightly bigger just enough to really screw things up. The misappropriation in the handling of my glasses has caused me numerous medical appointments, doctor bills, medications, pain and suffering in the form of migraines, worsening vision, and loss of income. The response from Alex was essentially that Lensabl could not and would not replace the one lens. I'm also sorry that my response to your request to replace the scratched lenses through our lens warranty came off as it did. Our warranty covers scratches to lenses from normal wear and cleaning, and the scratches in the photo provided were clearly not from that. It appeared that they glasses may have been chewed by a dog. It is now clear that the damage to the frame and lenses were from your attempts to correct the splay of the frames. I want to be clear that as far as I can tell we did not advise you to attempt to repair the glasses manually. If you had contacted us about this issue before that, we could have advised you that we could have the glasses adjusted to bring in the spay of the frames with a local optician, and that if needed, we can have the lab reinspect the lenses to see if there is an issue with base curve of the lenses. While we cannot replace these lenses for the damage done do them during a self repair, I can still have the lab reinspect them to see if an improper base curve was used. I am attaching a return label here. If that would be satisfactory for you, please let me know and send the glasses back to us at your earliest convenience. However, per your policy (see below): remakes are to be done if the customers satisfaction is not met and that I had 30 days to make Lensabl aware of the problem. I more than met the burden of proof in this case for one new lens easily, let alone small claims court would side with me. Your company damaged my property and then had the gall to try and get me to pay for the screw up. So on November 18, 2020 I submitted my re-order. On December 7, 2020 I sent the following at 9:49 AM: Ok. Now keep in mind that they were sent USPS Standard First Class, which by my research on usps.com states is between 1 and 3 days which means that the glasses should well have been able to be redone and completed judging by the time frames that you give on your website: How long will it take for my order to arrive? From the time that we receive your frames at our lab, lens production is about 4-7 business days on average. All lenses go through a meticulous quality inspection before being shipped back to you. If there are any imperfections at all, we may re-process your lenses so they are perfect, which can delay final shipment. Once shipped, you will receive an email confirmation with tracking number. Judging by that even in the worst-case scenario by mailing my glasses back on November 19, they should have been at your lab by November 21, 2020. And adding in, even 7 business days, would have been December 1, and adding on three days for shipping back that would be December 4, and even with a delay, arriving on the 5th. Regardless I still had had absolutely no communication with anyone at Lensabl, who now have not only my money but my property as well. Then on December 10, 2020 at 937 AM I received this response from Megan on your Customer Care Team: Megan (Lensabl) Dec 10, 2020, 9:37 AM PST Hi Nicholas, I am very sorry to hear that your lenses weren't working for you. Here at Lensabl we have a strict redo/remake policy, if there was anything wrong with the lenses that needed to be corrected by us, you could contact us and we would trouble shoot the issue and set up a redo. https://www.lensabl.com/returns/. I checked all email communication and I am not seeing that you reached out to us in regards to any issues with your lenses, only until after you had attempted to fix them yourself. Our lens warranty does not cover damage like this or scratches stemming from dropped frames, improper lens care, or lens cleaning with any substance and accessory other than Lensabl provided cleaning kit. I understand that you are in need of new lenses, and if you would like for us to replace these for you we would be more than happy to offer you a large discount to help ease the cost at 30% off MSRP $81.90. Best, Megan Customer Care Team www.lensabl.com I had further correspondence on December 10, 2020 at 3:02 PM, in which I responded with the following: A discounted price so where is the correction made for the sunglass frames that you destroyed of mine because I have clear pictures which will be sent to you if you all havent seen it yet that the lenses were not even the right curvature my sunglasses were stretched and theyre indestructible theyre OSHA approved not to mention I had yall make me a pair of sunglasses not only OSHA certified but essentially beach going theres no screws in the frames to adequately replace the lens but theyre cheap sunglasses like I said if yall had done it right I should essentially have been able to take a lens out of those glasses and put that lens in the exact same frame which I own on three pairs of it is as clear as day that the very beginning of this begins with the job not being done right I work around machinery that can kill you 5000 different ways outside and didnt have time for another four weeks nor do I feel I should have to pay for one lens that clearly with proof photo evidence shows yall *** the bed I tell u what you can simply send my package back to me and cut me a check for the price of those sunglasses which I will send a link to for you so you can clarify the dollar amount of the lenses which I have before and after pictures of before they came to you and after your stretch them so bad that I could fit the identical pair inside of them see attached photos Im asking for a little lens you destroyed my sunglasses had I known the lens was too big for the frame I would not have popped it out to try and put it in a different pair of frames to fit properly so I dont die at work so I can see for the two near almost 200 I paid with yall got a question for you so if you charge me 400 does that mean i wait five months for the same here or what. I cant seem to get contact with anybody via the normal channels that lensabl publicizes on their website, so yeah Im going to go ahead let my lawyer contact you from here on out. If this is how you conduct business no wonder your Better Business Bureau rating sucks ass. It wasnt until two days later on January 7, 2021 at 5:26 PM that we received a reply. In this particular email you can see where there is confirmation that the frames were damaged and were risky to work on. However, Lensabl would go directly on to say that they could still work on them if I wanted them too. It seems pretty cut and dry and any reasonable person would tell you in this case that if the frames were not compromised the first time I sent them, and I reached out with my dissatisfaction, then they must have been compromised somewhere in Lensabls possession. Hi Jill, I spoke to the lab and they confirmed that they received your frames but if you want us to redo the lenses you would still need to pay for those lenses to be replaced as my email below here has stated. The lab also confirmed that since the frames are damaged, they are also risky to work on. If you want us to proceed, let me know and I can charge the card on file for $81.90 as stated previously. On January 14, 2021 at 10:08 AM, after a few days to try and calm down, sadly only getting more and more irate at this whole situation this is my final correspondence with Lensabl via email: Megan Or lenasabl. First let me thank you for sending me back glasses that you ruined without even giving me the common courtesy after $180 dollars of putting my lenses back in I feel like I was very reasonable in my request for yall to replace one lens that I paid for protection for that never wouldve been damaged if you wouldve cut them right so heres how this is going to go Ive already presented yall with two very reasonable options to deal with this matter both of which she told me to go to *** which I will do but not before doing what Ive already done reaching out to my personal attorney here in Omaha who is intern going to reach out to an attorney thsts local to you at which point I will seek damagesFor pain and suffering due to the four months without resolution yall of had my glasses basically. loss of wages from being pulled off machine at work because I cannot see. The frames I sent you were overstretched by your technicians I have that in writing from an eye doctor as well as from yall that they were stretched too far I have reached out to the manufacture of the lenses themselves and ask them if I can send them in these frames so they can tell me whether they have been compromised past The OSHA certification or not at which once I have compiled enough evidence to prove that were both wrong here but you know it and I know it and in in your website it says I wouldve received my glasses within two weeks of the purchase it took nearly 2 months and you could tell me yall are busy but I will have you know as a fact that none of the eye doctor Dr. places during that time were seeing anybody due to COVID-19 and I did not order any type of colored lens that would require the extra 4 to 6 weeks The point is we can go on all day and now that Im on unemployment due in part to this matter I have nothing but time on my hands time that I would say it would be spent trying to make yawls life a living *** however this comes down to a very simple matter customer satisfaction of being right I simply asked for the replacement of one lines the curvature of the lenses that yall made for me may be different because of the actions of my eye however the shape of the lens the outline shape that it should be in size she did not differed whatsoever there should be no edges overlapping another edge I mean thats just common sense two wrongs dont make a right however if they cant make for a trial date at which point youre forcing my hand so this is my final attempt at once again requesting and demanding that you honor the left lens warranty and replace my lens. Respectfully, ~Nicholas Cummins~ When I did receive my glasses back, the lenses were not placed inside the frames, and in fact the whole thing was akin to Lensabl just *** in a box and sending it to me instead of my glasses. The lenses were thrown in the box with no care if they would scratch on the way back in the mail. So I had to risk ruining the lenses more to use them, or who the *** knows what I was going to do with this. So for a reminder and a timeline: September 5, 2020 I place my initial order after extensive communication discussing whether you could do my frames. Get glasses back sometime around November 12-13, 2020. I reach out to you initially on November 13, around noon. After providing extensive photographic evidence of the damage to my frames in comparison to a sister pair I had here that was the same model and everything, it took another five days before anyone could be bothered to communicate with me. Next communication was December 7, 2020. The gap in time was due to the holiday and much needed de-stressing time. Three days later I get a response from Megan telling me we could send them back for a re-do with a nearly $100 cost. December 10, 2020, I responded, and we decided to go ahead in early November to do the re-do, and no status update whatsoever until my fiancée reached out in early January and I had my final correspondence in the middle of that same month. So by my estimates from start to final correspondence via email that is September 5, 2020, to October 5one month. October to November 5.two months. November to Decemberthree months. December to JanuaryFour months. That is four months for something that by my estimates 3 days to ship to you, a week to do the lenses, and another 3 days to come backI could have done these glasses 8 times. I have come to the resolution that I will be filing in small claims court for damages, the cost of the frames, and the cost to Lensabl. You defrauded me. By my estimates there are approximately 10 employees that work for Lensabl, and that is including you, Andrew. According to the Better Business Bureau, you have a 3.28/5 rating, and there were 115 complaints closed in the last 3 years, and 70 of those were in the last year. Your rating is an F. 90 of those 115 over the last year were for problems with your products and services. Over and over and over across the internet your reputation sucks. Repeated customers saying you did to them what you did to me, destroyed frames, made them unwearable, and then attempted to charge the customer again. Further, according to the BBB, customer complaints are NOT used in the determination of your rating. Since you leave me no choice, if there is no response to this letter, all legal rights shall be explored, including, but not limited to, legal proceedings necessary to recover the refund I am deserved. I have sent two letters prior to this, so consider this a final warning. This demand letter for payment serves as official notice to you and may be tendered in court as evidence of your failure to pay. If legal action is to occur to resolve this matter, it may involve having you pay attorneys fees and may impact your business license and subsequent incorporation as a business/ I truly hope that you didnt know about this Andy, and that you will do the right thing and resolve this.
