Futon broken within two months

We purchased "Essential Home Linden Click Clack Futon - Gray" from Kmart store, Illinois, USA. It was already uncomfortable to sit on but still we tried adjusting to it and after two moths of purchase, one of its leg broke off. When we complained Kmart, they said its our of return period i.e. 45 days. After many calls they asked us to talk to Essential home customer care. Now tell us what shall we do
