Zero Halliburton Aluminum Luggage-You Dent It…You Own It

I have proven that Malaysian consumer rights are a sham and, for all intents and purposes, are meaningless. Let me share with you what happened to me. First, I am interested in replacing one of my suitcases. I started visiting luggage stores to see what my choices were. I visited an Austin Reed store and a Samsonite store and was headed to visit a Rimowa store next to make a comparison because I heard that they were pretty good. In the vicinity of the Samsonite store was a store with a sign on the outside that said Zero Halliburton, named Ace Bags & Luggage Outlet. My friend suggested I go inside to take a look because my friend had heard that Zero Halliburton made pretty decent suitcases. Once inside the Ace Bags & Luggage Outlet, I found the area in the store where most of the Zero Halliburton pieces of luggage were on display. The salesman asked me if there was something specific I was looking for. I said I’m looking for a replacement suitcase that is very durable. I shared with him the other stores I had visited and was on my to visit a Rimowa store when my friend suggested we stop check out the Zero Halliburton luggage. The salesman then pitched to me that the luggage was “bullet proof” and that it was more durable than luggage produced by Rimowa. The salesman argued that “…Zero Halliburton luggage used thicker aluminum and therefore was stronger”. With this understanding I proceeded to inspect a piece of luggage that seemed suitable to what I was looking for in size. Since I wasn’t carrying a gun to actually shoot the suitcase to confirm whether the salesman’s pitch was true or not, I started to lay the suitcase down on the floor to stand on it to see if it was really as durable as the salesman said it was. He stopped me and said I’m not allowed to do that. I asked him then how can I confirm that the suitcase is as durable as you say it is? The salesman then proceeded to open a small foldable velvet covered stand to place the suitcase on. He opened the suitcase for me to inspect the inside of the suitcase. It was clear that the space inside the suitcase would not satisfy my needs and there were metal strips at the top and bottom with sharp edges that could damage whatever contents I put inside the case, as well cut fingers during the process of putting those things inside the case. He closed the suitcase when I told him this. He then set the suitcase on the floor and started to fold the stand up to put it away. As he was doing this I twirled the suitcase around on it’s wheels to see how it rolled. It rolled very nice. I then, in the spirit of seeing whether the salesman’s pitch was true or not, bumped my knee into the side. This resulted in a dent. I was surprised. My knee is clearly not a bullet. In my opinion, I think that my knee is actually quite soft compared to a bullet comparatively speaking. For me, it confirmed that this suitcase was not as durable (or bullet proof) as per the salesman’s pitch and that it did not meet my expectations. With this understanding, I wanted to go and visit a store that supplied Rimowa luggage to see if they had luggage that would meet my expectations. As I was about to leave the Ace Bags & Luggage store, the salesman stopped me and informed me that I could not leave the store until I paid for the luggage I had inspected...because of the dent I put in the side of the display sample with my knee. Subsequently, his superior informed me that the luggage was for display…and because I put a dent in it I had to pay for it. I responded, stating that “that is the purpose of a display piece…to test and see what it’s actual durability is before committing to purchase it”. Further to this I shared with the sales superior person that I had just been to an Austin Reed luggage store and a Samsonite store…where I had been permitted to test similar luggage pieces by putting my knee into them to test their durability and wasn’t required to pay for the luggage pieces I tested. Looking at the sales supervisor person..I responded to their command to pay for the luggage with “no, I’m sorry..I want to go and test a Rimowa luggage display sample first to see if the first salesman’s pitch was true”. After some discussion about proof of durability and the purpose of luggage pieces on display, the sales supervisor gave me permission to leave the store without purchasing the piece. On my way to exit the store, however, another store staff member informed me from behind the sales counter that he was going to call the authorities if I didn’t pay. I respectfully said “excuse me?” and tried to exit. He then moved to block me from exiting the store. He then proceeded to tell me again in a more authoritative tone of voice while blocking me from exiting the store, that I must pay or else he will make a police report. I now felt a little fear and concern. I presented to him that I had been to the Austin Reed store and the Samsonite store where I tested luggage on display and they did not stop me from leaving the store unless I paid for them. Meanwhile, while I was conversing with him, my friend overheard the first sales representative making derogatory remarks in Malaysian about me. My friend decided not to inform me of this immediately in the spirit of waiting to see what other insulting comments he was going to say about me. I then waited, under what I felt was duress, until the “authority” arrived. Upon arrival of the “authority”, the tall intimidating sales staff member, who blocked me from exiting the store, started conversing with the “authority” in the local language. Meanwhile again in the background, the first salesman was making more derogatory comments in the local language about me in a very bad-sounding way, according to my friend. Now I was very concerned and worried…having no idea what actual authority the “authority“ looking type person had to make me pay for the luggage. Ultimately, I begrudgingly purchased the luggage piece out of duress under what I felt was “fear” pressure by the staff and the person of “authority”. Please note, that nowhere outside the Ace Bags & Luggage store or inside the store is there a sign that states that if the customer damages any of the display merchandise that they are required to pay for it. It is stated in Malaysian law that no one is obligated to purchase any merchandise on display with the understanding that display merchandise is only meant for the purpose serving as a sample for review. Further to this, there is no sign outside the store or inside the store that states that there are no refunds, exchanges or substitutes allowed, and that all sales are final. It is only noted on the receipt after the merchandise is actually purchased. According to Malaysian law if the refund policy is not clear before you purchase merchandise then a "no refund" policy is irrelevant. Parallel to this, I was not informed verbally by any staff members before being forced to pay for the luggage at the checkout counter...therefore then it is against Malaysian law to refuse to give a refund when requested...no matter what the reason. To make a long story short...I filed a claim with the Malaysian Tribunal based on Malaysian consumer rights laws for a refund and lost. I have proven that Malaysian consumer rights are *** Come to find out I have also discovered that one of the salesman at Ace Bags and Luggage is good friends with a Malaysian police officer in the Genting police station. I found this out while filing a police report. During the process his police buddy recognized the salesman's name on the police report and called him to warn him that I was at the police station. Shortly after that the police chief called me to a phone behind the counter and told me that my report was irrelevant and had nothing to do with the police. There's more...but I think I've said enough. I am pissed off at both Zero Halliburton and Ace Bags and Luggage for not even trying to negotiate with me in a civil way...cause I was willing to repair the dent (by pushing it out with my hand) but insteat chose to call the police.
