Poor customer service after an accident

We were hit by a Geico insured vehicle. Police report shows who is at fault. Geico claims they are not able to get in touch with the driver (its been 3 weeks) and they can not proceed without talking to him. The driver is not the owner, they have spoken with the owner. The driver did not have a valid license and the tag on the car was not the tag registered to that car. That driver is not going to contact the insurance company. The car is insured but Geico is not doing what they have been paid to do. If you are in an accident, contact a lawyer immediately and pray that geico is not the company you have to deal with.
