Recourse Claim
Gjensidige is acting unfairly towards its customers and exploits the customer's ignorance. Situation: I bought Octa's insurance in Gjensidige in 2008. In 2008, there was a road accident where the culprit was me. We wrote the agreed statement because the rear bumper of the damaged car had been scraped. So - nothing serious. It is 2020 and an amount of USD 700 was deducted from my account following a court decision to recover a recourse claim from Giensidige. The practice is clear: the MTPL law states that I am also obliged to submit a copy of my harmonized statement to my MTPL insurance company. If I do not do so within 10 days of the accident, then the insurers have the right to file a claim for recourse. They have sent a notice of recourse recovery, court dates, etc. to my declared place of residence. I did not live at the declared place of residence, so I have not received anything, but it is my fault, everything is ok. When contacting Gensensige and asking if they do not remind the client to send a copy to the insurers, there should be no recourse claim, The answer was a short-to-do not required by law. To my question whether it is not required by ethical norms, good practice and fair treatment of my client, I do not receive an answer. I have continued to use their services for many years without even knowing that recourse has been brought against me. I have received emails, phone calls from the Gjensidige insurance company, but no one even mentioned the court in a single word. Then it turns out that in order to sell a service to me, they use all possible ways to contact me, but to inform the court - then there is only the address of the declared place of residence. Not to mention a simple reminder to your customer. Calling all possible institutions: CRPC, FCMC, LAA, I get one answer: yes, it is not ethical, but unfortunately the law does not provide for any other action and it is only up to the companies themselves to apply any practice and unfortunately Gjensidige is at the so-called "bad" insurance company. I would warmly advise anyone to never insure Gjensidige if you do not want to cause yourself unnecessary headaches and a bored account.
