A landmark lawsuit is being waged in New Mexico against CIT Group, Vericrest Financial and Lone Star Funds all who have an economic interest it the home mortgages originated by CIT Group. The Defendant in the case has successfully fended off a default judgment for NONPAYMENT of his mortgage due to IRREGULARITIES in the posting of his payments to his loan. His Counterclaims have alleged that CIT aka Vericrest Financial which is really owned by Lone Star Funds of Dallas, Texas who are the real owners of the Note and Mortgage have consistently overcharged his account with fees and false charges not afforded in the Note or Mortgage. The Courts are now looking at why the real owners are not making themselves known in the case. This case is uncovering the fraudulent actions which appear to be more of a standard practice in their servicing of CIT originated loans. The borrower feels that there are many if not all of the borrowers have been treated in the same manner and based on the DEFENDANTS FINDINGS, a CLASS ACTION SUIT is in order.
