Effective September 1, 2019 VRBO.com and HomeAway.com has implemented new taxing policy changes forced on to them by states requiring collection and remittance of vacation rental property revenues to pay both sales and tourism taxes. However, they were not forced and charged with the payment of local or county tourism taxes, which many state, counties require for vacation rental properties. Their prior policy was to allow property owners/managers to simply enter the percentage of taxes to be collected at the time of booking and have the owners/managers pay their taxes as required by law in their own states and counties. However, under their new SOP effective 9/1/2019 they are now only collecting the mandated state sales and tourism taxes and not the local/county taxes. And there is no mechanism to add the additional taxes to their platform at the time when the guest books such properties. Therefore, the owner(s)/manager(s) are out of pocket and/or not in compliance with the local/county required taxes to be paid, since they were never collected as they were prior to the 9/1/2019 SOP. This has created a tremendous financial vacuum for vacation homeowners under their new policy for the collection of taxes. Either the local/county taxes are paid out of pocket by the owners/manager or they are not paid at all, resulting in non-compliance with these local/county laws which is subject to fines and or worse. It is apparent that VRBO/HomeAway did not have a full understanding of what impacts this new SOP will have on owners/managers that have local/county taxes to collect the revenues generated by vacation rentals. In review of these facts, it would appear that VRBO/HomeAway has now "tortuously interfered" with owners/managers ability to full comply with the taxing requirements that they can no longer afford or comply with.
