Out right false advertising

Originally ordered rack and pinion assembly from Detroit Axle thru their Ebay store. I actually talked to them to confirm some product details and then ordered thru Ebay. On their site it said 10 assemblies were in stock and same day shipping. I called them several times concerning tracking and other part details. Average time to even get someone on phone was 35 mins. and then could never get a straight answer. Then one rep tells me these can take up to two weeks to build. This is 4-days after I ordered and was supposed to be about when delivered. So, nothing has even been shipped. I tell the rep you can not say you have 10 in stock and same day shipping and have no parts. I ask for a supervisor or someone that can give a good answer. He tells me they will call back in an hour.That did not happen, of-course. Next, I complain to Ebay, who does not seem to care about the bait and switch advertising of one of their stores or that their customer has waited now a week for a 4- day order. They tell me to give them till next week, which would be closer to two weeks from date of order. I inform Ebay that they are basically working in concert with false advertising and their answer is unexceptable. No customer service from both companies. Last I looked it still said 10 in stock on their site. I had no choice but to contact legal counsel. User's recommendation: check competition.
