Not my experience

I have worked for the company for 3 years and never had this issue - if I am out of hours, i'm out. The owner is the last one who would let the dispatchers run drivers out of hours. She is the one I go to if I have a problem with anything. Its always taken care of. If you were getting close to your 70, your dispatcher should have known it the day before or prior to that. Figuring out that you are out of your 70 in the middle of a run or the morning before a planned run puts everyone in a bad position.
