I was recently notified by PHH that they require me to complete a final loan modification for the 3rd time, for the absurd reason that the co-signor signed as "attorney in fact" instead of "power of attorney". Even though the legal definition is: "An attorney-in-fact is a person who is authorized to act on behalf of another person, usually to perform business or other official transactions. The person represented usually designates someone as their attorney-in-fact by assigning power of attorney." Each time we have signed the agreement, my attorney and the co-signor's attorney have thoroughly reviewed the signatures to ensure they were legally sufficient. In addition, they mailed me the documents on 4 December, but I did not receive them until 18 Dec, and they gave me a suspense date of 22 Dec to return them. An impossible feat during Christmas week when everyone is closed.
