Job Completely Abandoned by Contractor

I was seeking a landscaping contractor back in August 2018. The original job entailed simplifying the landscaping, clearing several areas where my late father had excessive landscaping, and removing a chain link fence. Timothy Nelson of Shoscapes Landscaping gave me a bid of $8200. In September 2018 after the bank finally released my father's funds I gave Mr. Nelson a check for half of the amount $4100. They worked on the project sporadically after a few days. All sorts of excuses were given as to why they were not working on my project. Two additions were made to the original project, removing some trees and building a small retaining wall and an edge around a flower bed in front. Mr. Nelson and I agreed on $2600 and $3600 respectively for the projects. I paid Mr. Nelson in full for the tree removal, which was done, however I should have been suspicious because he asked for a check payable to him and not his business. He supposedly used a subcontractor for the tree removal. I also gave him a check, payable to the business for $1800 for half of the second addition to the project. The workers came to my home more and more sporadically. Despite the fact that I went over the details twice with Mr. Nelson my instructions were not followed. Among other things they did not do the flower bed in my front yard per my instructions and they cleared an area I had specifically instructed them not to do until some flowers my father had planted literally fifty years ago could be transplanted. For the latter, in all fairness I did at least get an apology and Mr. Nelson's crew did plant some replacement flowers I bought free of charge. They also damaged the sewer vent in my front yard with the bobcat. I was assured that the damage would be repaired and that the project would be completed in December. In good faith I gave Mr. Nelson a check for $1800 for the second half of unfinished retaining wall and foolishly another for $2000 payable to Mr. Nelson so “his crew could get paid.” It is now April 2019, the is at best half completed, I have a huge pile of rubble in my back yard, pallets stacked in front blocking the sidewalk and Mr. Nelson’ telephone numbers have “call restrictions” because the bill on them has not been paid. Absolutely DO NOT HIRE THIS CONTRACTOR.
