Internal fault in Bullet 350 bs6 EFI

I bought one week ago bullet 350 bs6 EFI and after run of 400 KMS bike start missing and off after that bike is not starting then I call on road assistance and took my bike to service center they checked and tell relay is becoming hot that's why it happens, so now I want to replace my bike otherwise I will file case against the dealer or company thanks..do User's recommendation: Dont but without proper check.
