Failure to perform on your contract with us

we started in January with a contract with you for phone service. One month ago they started to finally do the install. Two weeks age they were short phones and told us 3 days they would have them. They have not been back since. the phones from are old system that we are keeping are down and they have not been back to get them operational. They have no concern over the customer. I have repeatedly called them about this and all I get is lip service. I am about to have our lawyer file claim for non-performance of contract and damages if this does not get resolved.
