Difficult to work with when married

I have a 401k with them through my employer. I see it as my money. I work hard for what I invest into my plan. Only now my husband is incarcerated in another state. We have a roof in need of repair, but I can't take any money out to fix this without my husbands consent. Yet, its my hard earned money since before i was married.
