If I may begin by saying I’m a concerned investor with information that should shine more light on the FCA's investigation into the business activities of Samuel and Shantelle Golding via Outsourcing Express Ltd, DWS Ltd and Kerching. •The investigation into their activities began several months before the October 2017 date being mentioned by investors. •It is correct to say that all Finance and Investment practices are regulated by the FCA however this also includes the businesses that choose to ignore regulation. •Irrespective of what word was used to promote their business, i.e. investment or private agreement, etc., it still involves members of the public paying out sums of money to a business that is promising returns on monies paid. This sort of financial activity has to be regulated under UK law. •In the case of Samuel and Shantelle not only was their business unregulated but on further deeper scrutiny their business model was unsafe. It transpires that there was no real business i.e. no trading or shipping of goods worldwide generating nonsensical amounts of profits every 12 weeks. •In fact what they have been running is a Ponzi scheme. For those who do not know; a Ponzi scheme is a form of fraud in which a purported businessman lures investors and pays profits to earlier investors using funds obtained from newer investors. This is why there has been a reported 'shortfall' in their business accounts as no money was really generated from the business. What occurred was simple redistribution of the investors’ money, anticipating that most of the investors would not withdraw their investment in the hope of obtaining higher yields through compounding. Investors who chose not to compound their investment thereby requiring payment on the due date (usually 12 to 16 weeks after investment was made) would simply be paid by the monies held for the other investors who chose not to withdraw and to compound their investment. And finally please note that at some point this will become a Police matter and handed over to the Serious Fraud Office for prosecution of the Golding’s. •Potentially each investor would then become a witness for either the Defendants or the Crown. •It is therefore crucially important for investors not to be coerced by other investors/members into misrepresenting the facts as they stand. •Any attempt to misrepresent the facts will be seen as ‘perverting the course of justice’ and the offender/investor will be liable for prosecution. For example investors being instructed to do the below is unacceptable- “From today, please refrain from using the following: Consumer, Investment, Investor, ROI, Profit. Instead use: “Members”, “Family & Friends”, we entered into a partnership with the Companies”. •All monies held in the defendants business bank accounts will remain frozen until the conclusion of a trial, as this is evidence for the Crown.
