Cancelled it, still charged, won’t refund

I called and cancelled my membership. I made it very clear I want it cancelled. The guy on the phone said okay then offered to refund my $39.90 and said he would still leave my account open until the end of the month because it's Christmas. He acted like he was doing me a favor for Christmas. He said if I change my mind and I want to opt back in, to give them a call. I got charged the next month, and I spent 45 minutes on the phone with a supervisor arguing about how mine and the guys conversation went. He was picking and choosing what to repeat from the conversation and said if I want to hear it, I have to get a subpoena. He finally said he would refund the money and of course he hasn't.
