brakes being out of adjustment

I have worked for this company for 13yrs when i had my first accident and got fired. because the brake lever was out of adjustment or didn't make go connection when i applied it and slipped back out and accidentally hit the reverse lever and tow motor went off the dock. Our policy book reads we are to receive a written warning a suspension and then maybe termination with in a one year period. but it is ok for a part timer that got hired in by a supervisor to do the same accident and receive nothing a month earier, but the shop found that his was out of adjustment. How would they come up with that without the tow motor running?
