Bad experience with 501K recycling in Tennesse Never pay them advance

On November 30th 2017, vide our purchase contract 1089/SWG/2017 we contracted to purchase 190MT unvulcanized tires from 501k Recycling represented by Johnny Pearson and Kiley Pearson. they acknowledged our purchase order with a Invoice and demanded full payment in advance. We remitted full advance payment on December 15th, 2017. Total 10 x 40' containers. They then told us the cargo would be delayed as their baler was frozen. They delivered 6 x 40' container in January but claimed they did not have a scale so there were no weights available. Surprised that a scrap dealer does not have a scale. Further we were invoiced in short ton and not metric ton which is a 10% difference. Additional we also purchased 23,000lbs of rubber compounds which we did not pay for until we had loading pictures and scale tickets since we were annoyed that they took 3 months to ship after being pre paid. So finally they loaded the balance 4 containers and additionally one container with 23,000lbs rubber compunds and the rest with unvulcanised tires. we asked for loading pictures and they took 4 days to provide the pictures by which time the containers had already been railed out of Memphis enroute to Charleston and thereonwards to India. The loading pictures were very blurred and they said that they had loaded the compounds in the corners which we could not see. we cancelled the order for these 2 containers and asked them to provide us instructions to take back their 2 containers. Instead they went ahead and sold all 5 containers to a local client in Chicago and demanded him for pre payment. We told them they had no right to sell our 3 containers which had been pre paid in December and even after we retunred the 2 containers to them, there would be a considerable amount owed to us. They were forcing us to pay over and above the contracted rates and we told them that we did not accept the 2 containers due to lack of proof of what was loaded. They started to threaten us and made poor attempts to blackmail us and try to stop our containers from sailing. Cargo which we have pre paid for in December. DO NOT PAY THIS COMPANY ANY ADVANCE PAYMENT. THEY TAKE YOUR MONEY AND FEEL THEY HAVE THE POWER TO LOAD ANYTHING THEY WANT AND DO NOT FEEL OBLIGATED TO PERFORM AS PER OUR PURCHASE CONTRACT. PLAYING TRICKS - SELLING YOU IN METRIC TONS AND THEN SHIPPING YOU IN SHORT TONS. UNCLEAR LOADING PICTURES. PROMISING CARGO WHICH THEY DO NOT HAVE. Be very careful of these people they are dishonest down to the marrow of their bones.
