87 year old widow bullied by Hayden Homes

February 28, 2018 Attorney General’s Office Lawrence Wasden 700 W. Jefferson Street, Suite 210 Boise, Idaho 83720-0010 Subject: Audrey Chase v. Hayden Homes Dear Mr. Wasden: Please take action on the revised information. This is way beyond any consumer protection issue. My case is Elder Abuse and a $262,000 financial fraud. In my opinion, Hayden Homes and New Home Star Idaho Realty are engaged in consumer fraud, deceptive sales practices, shoddy workmanship, breach of contract and violations of codes and law. I believe this is fraud on a massive scale that has gone on for years. In my case, they tried to force a mold infested situation of a house on me. When I protested, they refused to honor my valid contract and wrote that they were selling my home to someone else. In response to my BBB Complaint, Mike Newell, Hayden Homes Regional Manager, falsely and repeatedly stated that they have already returned my money. As recently as 2/27 Mr. Newell wrote that the money was at “the title company”. He never identified the company. My Realtor discovered it should be Pioneer Title in Coeur d Alene. As of 2/28 the money was not there. I was never given anything that indicates an escrow was ever opened or that my money was deposited according to law. Hayden Homes falsely stated in an email and voicemail that it would be sent certified mailed to me. As of 2/28 it was not delivered. Attached to this expose' there are multiple pages of other victims complaints from all over the State of Idaho, Oregon and Washington. Including mold victims in our area; with reports of the New Home Star Idaho Sales representatives outright lying to buyers to lure them into a contract and then ignoring shoddy workmanship and warranty claims. My BBB complaint contains similar information as noted above. Quotes herein by Mike Newell and Hayden Homes are from their responses. I have proven with photos, emails and documentation that their responses are not true and not based on fact or common sense. 87 year old widow bullied by Hayden Homes Hayden Homes has bullied an 87 year old widow that simply asked them not to create a mold infested home by installing wet insulation into a wet house. There was no house wrap or siding on the home. High winds were continually forcing the snow and rain into the house and blowing the insulation out into the snow and water on the ground. The house was never dried out. See attached photos. The attached pictures show the wet insulation laying in the snow and water for a week and then Hayden Homes re-installed the insulation back into the walls. Note the wet floors and framing in the attached photos. The house wrap was not put on until 2/20/2018; look at the dates of the pictures. My Realtor is also aware of this. Hayden Homes response from Mike Newell to my complaint of wet insulation and mold: “…I personally was in this home to make sure it was clean and dry”. “I have personally been to the home on multiple occasions to review these items and discuss them with my team. During my visit yesterday, with our senior project manager, we found the house, insulation, walls, and subfloor to all be dry and in good condition.” The house is NOT dry, the insulation is NOT dry; IT IS FROZEN with the water in it. I will attempt to explain to Mr. Newell the desorption phenomenon whereby a substance is released from a surface in sorption equilibrium between bulk phase and an adsorbing surface (ice/water through insulation to wood) equals mold; and why in a dielectric measurement circuit the water polarized in the electromagnetic field solidifies in the ice matrix and no charge is measured (0% dielectric moisture content reading when frozen). When it thaws out there will be water trapped in the plastic covered walls. The insulation and wood will be wet. It will mold. During freezing temperatures the moisture content can’t be measured. Look at the weather, wind and temperatures over the last two weeks. Then look at the wet towel photo (representing the insulation and wood) when the ice melts, the moisture content is 32%. That is what the house at 1092 W Staples Rd., Post Falls, ID has in it. Look at the photos of the wet wood. Mold will grow in the walls. Look at the attached picture of black mold in a wall that nearly killed a woman in Tacoma. Hayden Homes has acknowledged that “mold causes serious symptoms and diseases that may even be life threatening” but Hayden Homes then states they are not responsible even if it is caused by “defects in our construction.” See attached Hayden Homes Notice, Disclosure, And Disclaimer Regarding Mold. We also have photos of the bent furnace flange that will spew hot air into the attic; holes in the walls above the fireplace letting water into the house and the insulation that is covered in plastic which traps the water and creates mold. The fireplace gas line does not have a required drip leg or accessible gas shut off valve. The gas valve is inside the wall where I could not get to it in an emergency. See the attached. We notified Hayden Homes of these code deficiencies. They ignored me. There were four of us at the Hayden Homes model, including my Realtor, when the sales woman repeatedly told us that we could visit my new home at anytime and that I would be called and on-site to make sure the tv/phone jacks, that I paid additional money to get, were where I need them. I was never called. By chance, we noticed the electricians in the house and checked to see what was being done. They had missed one bedroom altogether and other jacks were in the wrong place. The electricians corrected the errors, without any cost to Hayden homes, and saved any costly wiring rework that would have been required after the drywall was installed. The rough-in was inspected and passed on 2/14. We notified the sales woman of everything and we believed everything was fine. They should have thanked me. Look at the message below from New Home Star Idaho- Hayden Homes sales agent, Natasha Palmer, regarding our visiting the site, finding their mistakes and assisting in the corrections before they became a costly issue. Quote: “Natasha Palmer Reply To me You did not cause a problem at all!!!! And if I had the experience in the industry like you I would do the same thing. Everything you showed me was valid and needed to be addesssed. All our home buyers are involved in the process and that's how it should be, it's your investment. When I said you don't have to deal with trades I ment it like so you don't have to worry about. Sorry if there was confusion. I just want you to have the best possible experience that's my job to make happen in all aspects Natasha Palmer|Sales Associate New Home Star Idaho LLC C: 208-818-7677” The Hayden Homes model has a heater mounted near the ceiling in the garage area. I would be doing art work in my garage and believed that it was not unreasonable to want to be warm at 87 years of age. At the end of the day after the electricians were done correcting the other mistakes, we asked if they would rough-in the garage heater if we paid them. They did, and it was part of the inspection that was passed by the inspector. No harm was done by me. In fact, this additional asset added value to the home. The only somewhat truthful thing told thus far by Hayden Homes is: “There has been no damage to the any of the systems and all work was performed by licensed contractors.” Apparently, the project manager threw a tantrum like a petulant child because we corrected his mistakes and he tore out everything. It is illegal to alter the wiring after the inspector leaves the site. The project manager’s actions resulted in the jacks being in the wrong place and wiring being damaged. Including, placing a phone jack behind the guest bath toilet. See attached photo. Contrary to the above email from Natasha Palmer; Hayden Homes then engaged in malicious actions against me, including, telling me not to go near my home unless they said otherwise. Hayden Homes then installed insulation into the wet house with no house wrap, no siding and large holes in the wall on both sides of the fireplace letting in the rain and snow that was being driven by high winds. As noted above, the wind blew the insulation out into the water and snow where it laid soaking up moisture before being re-installed. Hayden Homes sales agents refused to give us anything stating that they would repair any of their mistakes. They said "We can't make them do anything” referring to Mike Newell and the project manager. See enclosed letter from Iva Haukenes. Hayden Homes was informed at their model home and in writing that there was no house wrap or siding on my home and installing wet insulation in a wet home will create mold. We gave Hayden Homes written notice on 2/17 that a Moisture Intrusion Expert and a HASMAT Mold Expert were being brought to inspect the house. See attached. On 2/19 Natasha Palmer sent an email and voicemail terminating my valid contract stating that my money would be mailed to my address. Ms. Palmer also stated that they were immediately selling my home to someone else. My money was not returned. This is fraud. Mike Newell, falsely stated to the BBB that they didn’t hear much from us. “We have had little response other than through the BBB, a visit from the daughter-in-law, and a phone call with the son. The information we can disclose to relatives is limited, since they are not parties to the contract.” Another false narrative. In fact, emails were sent starting on 2/11 about the wiring and other defects. Photos were sent to Hayden Homes. The same ones included herein. Calls were made on 2/17 at 10:04 am; two calls with Hayden Homes headquarters on 2/19 at 10:52 am, 11:17 am; a call on 2/19 at 4:41 pm. These are registered on our phones. If they can’t talk to relatives then why did Mike Newell call to harass my daughter-in-law on Sunday 2/25/2018 at 6:47 pm from 541-604-6761. This is Mike Newell’s response to my BBB complaint about their mistakes: “These are simple items that would have been identified during our normal quality inspections if the buyer had not been in their home prior to the inspection.” If I had not been in my home correcting their mistakes they would have had hot air spewing into the attic. They had no idea the flange on the bottom of the furnace was bent open far enough to see the insulation on the inside of the furnace. They also would have spent thousands of dollars in tearing out drywall and replacing it after rewiring the bedrooms and bathroom. I saved them from all of this and simply asked to have the wet insulation removed from my home until it was wrapped, sided and dried out. Hayden Homes ignored me and destroyed an added value asset that I paid for; so I filed a complaint with the BBB. Complaint: #12688798. There are numerous complaints filed against Hayden Homes. See the attached 13 pages of other victims from the BBB files. An unsigned email dated 2/19/2018 on Hayden Homes letterhead states, in part, that they took this action because, in truth, I added value to the home and visited my $262,000 investment. As shown above, Natasha Palmer told me it was OK to be involved. Mike Newell’s response to the BBB about Hayden Homes egregious acts against me: “Unfortunately, our customer has violated their contract by unauthorized visits to the site” Our letter to Hayden Homes dated 2/17 states that if they won’t let the buyers see anything they are doing; then don’t use that ploy as a sales pitch to induce a buyer into a fraud. See the above Natasha Palmer email regarding the visits to my home. I was married to my late husband for 62 years. He was a custom home builder and I have been on construction sites since 1956. I drew the prints, ran the business, put in the yards and sold the homes. Just what do you think that I don’t know about construction, Mr. Newell? We never disrespected or treated a customer in the shabby manner of Hayden Homes. We never lied to them. We never had any complaints raised or filed against us, ever; unlike Hayden Homes. I did not receive it, but a voicemail sent to my relatives from Natasha Palmer repeated the Hayden Homes email and stated that my $9,400.00 would be returned via certified mail to my address. The voicemail ended with a snide comment at the end to "have a nice day and good luck finding a new home". The money was not returned. Mike Newell stated to the BBB that “..we have refunded 100% of their earnest money.” “This contract has been terminated for cause and we sent an addendum to their real estate agent earlier this week. Although we have been damaged financially, we have authorized the return of 100% of the earnest money.” This is completely false. No addendum was ever sent to my Realtor. No evidence of an escrow account being opened was ever given to me. I never received any return of my money as described by Natasha Palmer’s email or voicemail or the statements made by Mike Newell. Further, if Hayden Homes was damaged financially, they did it to themselves as is clearly documented herein. They cannot collect on self inflicted injury caused by their own malicious acts. In truth, I have suffered substantial financial losses directly caused by Hayden Homes and New Home Star Idaho actions. My contract with them equated to approximately $167.00 per square foot. The current rate for homes a block away from this home is approximately $180.00 sq.ft. The total immediate cash losses I probably will suffer are at least $82,600 plus the attorney’s fees to drag them through court. That does not include lost profits and appreciation based on the 13% market increase as noted by Sam Inman. Apparently, I am forced to retain our attorneys to collect on these losses at great expense to me. The only consolation there is that we will tie up the property title for a couple of years, according to my attorney. That gives me plenty of time to make this fiasco well known. All Hayden Homes had to do to resolve this was remove the wet insulation, wrap and side the house, dry it out and thank us for showing them the other failures in their product. Obviously, Hayden Homes, New Home Star Idaho and Mike Newell believe they can cheat and attack an 87 year old woman and get away with it without anyone knowing. They must not be keeping up with the news. Social media is very powerful and I am very determined to see justice done. I will be contacting the media. Among the people that mold affects the most are children and the elderly. Mold inhalation affects your respiratory system, therefore anyone who has preexisting respiratory issues is placed more in the danger zone. UNICEF: Clear the Air for Children “…suffer from respiratory diseases that diminish their resilience and affect their physical and cognitive development…. indoor air pollution are directly linked with pneumonia and other respiratory diseases that account for almost one in 10 under-five deaths, making air pollution one of the leading dangers to children’s health.” Those chronically exposed to mold develop a condition known as Chronic Inflammatory Response Syndrome (CIRS), defined as: “An accute and chronic, systemic inflammatory response syndrome acquired following exposure to the interior environment of a water-damaged building with resident toxigenic organisms, including, but not limited to fungi, bacteria, actinomycetes and mycobacteria as well as inflammagens such as endotoxins, beta glucans, hemolysins, proteinases, mannans, c-type lectins and possibly spirocyclic drimanes, plus volatile ogranic compounds.” CIRS is associated with 37 health symptoms, including asthma, dizziness, migraines, and bronchitis. BLACK MOLD Day 4 WET INSULATION WET WOOD and Floors DAY 5 WET INSULATION 1/9/2018 BBB Guarantee/Warranty Issues Complaints On 12/21/17 I filed a warranty claim via Hayden Homes website for a roof leak we have at our back porch where the water is pouring through the soffitting holes making an ice mess when it re-freezes. As of today 2/4/18 I have not received a call for someone to come and look at this and advise...on repairs. When we closed on this new home we were advised by Dave the Local warranty manger we would have a call within 72 hours of filing a warranty claim which has not been the history with Hayden Homes. It is not until after I am forced to file a BBB claim that we are contacted to resolve warranty issues. 10/12/2017 Guarantee/Warranty Issues Complaint In November of 2016 we entered into contract with Hayden Homes to purchase what we thought would be our dream home. In Feb of 2017, we discord we entered into a NIGHTMARE with Hayden Homes and *********. On 3/10, we were viewing our home and I noticed MOLD in the bonus room. They have used moldy... boards to frame our house and failed to bleach or kilz them. It was not until i brought it up and sent pictures they placed kilz on them. 3/25 went to view our home and the pantry door was framed in wrong, it was shifted to far over to the right. They re-framed it but heavily mudded it in front of the cabinets and we were at risk for sever cracking. My husband had to call a special meeting with Hayden's project managers and tell them this was not acceptable, they finally agreed to re-sheet rock and mud properly. On 4/9 we went to view the progress of our home and I noticed the fire mantel was shifted too far over to the right and was right and not centered and from the back of the house you could notice that the gas pipe was placed too far over. Hayden's project manager Paul stated they had 3 inches of play they could shift the fireplace over. Well this was not correct, after 5 attempts, 3 tile jobs and a brand new fireplace it was finally fixed the day before we closed. 5/13 we went to view our home, noticed the fire door was cracked after a few emails sent back and forth, Hayden was adamant the integrity of the jam was not compromised despite being cracked. When they removed it was discovered it was compromised as it was crack all the way through. We finally closed on our house on 5/26 but not without more major issues: Our bathtubs have been re-finished but someone not factory certified voiding our manufacturer warranty, we have had a shower leak, our roof had exposed nails and vents just nailed on top of shingles, we have paint all over our carpet, our kitchen wall split and a screw popped out already, and safety concerns with the taping of firewall. With all the problems we are now seeing and getting a letter from neighbor about an impending class action lawsuit against Hayden homes. Water leaking in the windows mold growing behind the walls. Paint chipping large cracks in there walls... We passed up some new construction due to poor craftsman ship. Figured we would do better with a house that is a few years older and settled.. Well with further inspection of our house it's seems water has been leaking inside and repaired. If you walk down the street you can see paint chipping on every house... This division was built in 2007 WTH did I get myself in to with Hayden homes???? 9/19/2017 Guarantee/Warranty Issues Complaint Have submitted a list of warranty issues within the 12 month warranty period, other than one email from what I assume was the Warranty/Customer Service Manager. I have initiated all contact with Hayden Homes in an attempt to resolve my warranty issues. It has been more than 30 days since first... submitting my list of warranty repairs and I have not been contacted concerning when or even if they will resolve the issues. Customer service seems to be non-existent or at least is not a serious concern for the organization. There is no good faith consideration for the customer. There is obviously no "commitment to quality" as they state on their website. 7/10/2017 Guarantee/Warranty Issues Complaint We have had our fair share of issues during the building process with Hayden Homes. Several email have went back and forth between their selling agent Darren D****** and myself on issues with this house. Upon closing, we have discovered out bath tubs have all been touched up and are peeling. When... asked what the warranty was with Detail Difference, she could not cite a warranty. She just said if there are issues she will come and redo as long as she owns the company or the company is in business. I stated i wanted out bathtubs stepped back down. It was never disclosed to us our bath tubs have been re-finished or touched up (which requires me to clean a different way). There was no warranty or guarantee paper work for the company they use to do this Instead the point the finger at the cleaners they use and say they must have came in to early to clean and it did not have enough cure time. E 4/27/2017 Problems with Product/Service Complaint I purchased a new Hayden Home that came with a one year warranty. They said they would come back and fix squeaks in floors, front door glass separation, drainage issues, broken sprinklers and repair sod that was damaged, etc. At 11 months I completed and submitted the form provided by Hayden... listing all the things that had developed in the first year. 2 different Hayden reps came out and looked prior to the warranty expiring and said they would fix when weather permitted, which I totally understand after this winter. However, I have now made 4 requests and am outside the warranty period and have received NO responses to my warranty issues except to tell me that I am now outside the warranty period. To me this is an unfair and deceptive business practice. 6/9/2016 Guarantee/Warranty Issues Complaint Hayden Homes chose to be cheap and have curb cut outs for several homes to be pre-cut when the road was put in. Unfortunately, the layout of the home is not known at the time the road is put in. When my house was built, the garage did not align with the cutout. So, my driveway connects to half of... the cutout and my front lawn is in the rest of the cutout. I pointed out the issue before closing and they claimed they would fix it. However, they are refusing to fix it saying the city signed off on it and it doesn't violate any city codes. This is true. However, the utility of the driveway is reduced as only one car can drive in and it looks terrible. They are reluctant to fix the bad work because my neighbor requested something before going to the city and Hayden was nice enough to put in cement for them. The city made them tear it out. I have full approval from the city engineer. Hayden guarantees a zero defect home and they have the vision to be “Greatest Homebuilder On Earth.” The warranty manager for the area admits it looks bad but refuses to spend the money to fix the sloppy work. If I was the builder, I'd be embarrassed to say I built this house. If you commit to the highest level of customer satisfaction, why not spend a little money to fix something you were too cheap to do properly in the first place? I bought a Hayden Home so I could afford a house, not so I'd spend a lot pf money trying to fix all the problems. They guarantee a home free from defects and imperfections. A driveway that is only half usable is an imperfection. Why refuse to fix it, against your vision and promise? 3/24/2016 Problems with Product/Service Complaint My husband & I are requesting a full refund of $3300 for earnest money we put down on a home we began building in *****, *****. Hayden Homes uses New Home Star of Id agents to represent & sale their product. The Community Manager for the Sub. we started building in was Michael T*****. I have... written to Dennis M***** CEO for Hayden Homes in Redmond, Or, on two separate occasions, once in Dec & when I didn't rcv a response I sent a certified letter in Feb, which was signed as rcvd by Kim G****** on 2/29/16. Since I still have not rcvd any correspondence back I am hoping filing this complaint through the bbb will get us resolution to our request. The reason for the justified refund is due to the horrific manner in which my husband & I were treated by Mike T***** & other sales associates with New Home Star. Mike made errors on our buyers selections order docs on several items by entering in the wrong description #'s, completely leaving things out (such as an extra window we had wanted in the kitchen) & forgot all together to even let us know about some selection options. Mike gave us false information regarding the 10 day grace period & refused to take ownership for his mistakes. When I caught some of the mistakes & emailed Mike about them, his reply was condescending, sarcastic & he was even so bold as to mock my words. My husband & I are in our early 50's & this was the first home we had ever built & wanted it to be our dream home. This did not happen. New Home Star agents did not live up to your companies noted expectations on delivering exceptional customer service & did not provide us with the home we wanted resulting in our experience being unsatisfactory. 2/23/2016 Problems with Product/Service Complaint We purchased our home from Hayden Homes. The real estate contract are amended by association bylaws and covenants, conditions & restrictions. Hayden Homes recently became the declarant and builder under CCR'S and have now have carte blanche authority under CCR'S because CCR'S to not require... turnover to homeowners until 100% of lots are sold. Hayden Homes is allowed to appoint a broad of directors who do not reside in the subdivision. They have recently decided to suspend enforcement of CCR'S until their construction is complete. Current CCR'S impose requirements of builder as well as homeowners so they have removed themselves from restriction. However, this allows all homeowners if they wanted to disregard CCR'S and establish any use explicitly exclude. Once allowed, these uses cannot be removed without extensive and expensive litigation. Hayden Homes uses Premier Properties as a management agency. This company will respond as they see fit but will NOT provide the name(s) of appointed board members. Hayden Homes does not provide access to anyone with decision making authority and when contacted with the limited telephone numbers and online access there is NO response. 6/23/2015 Guarantee/Warranty Issues Complaint We have several outstanding home warranty issues that you have not been completed. We requested home repairs on 1/18/15 and our last contact with the company was with ******* ********* on 2/5/15. We have called ******* numerous time and had to leave voice messages and have never received a call... back. We also filled out another online request for these repairs on 3/31/15 and again, no response from the company. ******* was to arrange for:1.Drywall repairs throughout the house due to the cracking in the ceilings/curve of corners, etc.2.Replace bottom trim/molding of front door 3.Arrange for the installation of the missing attic/crawlspace access in the master closet4.Rectify a cold draft issue which has had our den at 44 degrees this past winter, i.e. add insulation 5.Arrange for a laminate floor expert to come and evaluate the problems with our flooring, i.e. shifting of boards creating gaps and the buckling up of other boards. The opinion of the expert was to help decide if the repair should fall on Hayden Homes/tradesmen or the manufacturer, ****. We have had nothing but problems with Hayden Homes. The last three years have been a guessing game as to what will work and what will not work in this house. The most recent problem we encountered was when an AC company came out to install an AC. Today, we had someone come out to make one of the outlets active. Hayden ran wiring from one to the other without wiring them to the outside. The list goes on... Electrical in the kitchen was not wired correctly. The power was coming back on the neutral!!! It killed our refrigerator! We had to call 911 because gas was released as a result!!!! A subcontractor ran over the our concrete pad that we paid extra for. They were only going to fix it to the crack instead of the seam. Once it was fixed, we had rain and the patio was pooling water. Our hallway wall started cracking. They came out four times to fix it. Apparently, our house was not braced properly! The last time the sub came to fix the drywall they did not put up a plastic sheet. We had drywall dust everywhere for weeks. The heater was on in the house and basically sucked the dust up and spit it out everywhere. The water meter was in the middle of our driveway. They were going to give us a one car opening to a two car garage until we threw a fit. But we had to make contact with the city to see what could be done. DO NOT BUY A HAYDEN HOME! We just moved into our Hayden Home less than 2 months ago and have had the WORST experience. Our dishwasher started leaking after running it twice and warped our kitchen floor. When they came to fix the kitchen floor the contractor banged into the wall and put a gash in it, and ripped off our trim by accident and then tried to glue it back together... yeah it didn't work. They still haven't landscaped our front yard or painted our house as this is "weather permitting" although it's been over 70 degrees and sunny all week, and to top everything off when we tried to turn our air conditioning on it doesn't work! We have had nothing but issues with the warranty department and trying to get things fixed on the house. Just this past weekend on Saturday 5/25, I was in the attic and noticed a gas smell coming from the furnace. I immediately called the 24 hour emergency number for the warranty department. Nobody answered and I left several voice-mails over the weekend. I had the gas company come out and confirm the leak and shut the line off. It wasn't until Monday afternoon that I received a call back from a subcontractor that was going to come by and fix the line. I had left the customer service department numerous voice-mails as well as the emergency warranty number and nobody had responded to this issue. The homes are built so cheap, you will have nothing but issues once you move in. None of my interior doors would close properly because they were hung incorrectly. After arguing with them to have someone come out and fix it, the subcontractor told me whoever framed the doors used galvanized framing nails to install them. He was barely able to fix them. Whoever installed the kitchen cabinets drilled holes in them to mount them to the studs, but miscalculated the stud location and had to redo all the drilling. The cabinets had numerous drill holes on the inside and it looked horrible. The list goes on and one. The problem is, once you move in, nobody will answer your calls or get back to you regarding your issues. Their zero defect guarantee is a joke. When I cant close my bedroom door, that's a defect. Worst home ever The following id a code violation report on a home built in 12/2005 Foundation Inspection Deficiencies: 1) The foundation depth varies from 5 to 12 inches below grade. This does not meet the 12" minimum requirement. 2) The front porch footing is failing at the corner. According to the plans this is a structural footing and is also required to be at a minimum 12" below grade. 3) Grade around the structure is not sloped away as required by R401.3. I believe this has caused soil issues leading to multiple failures. 4) The structure appears to sit higher than most of the structures around it and I question the Engineers report where it states "the entire foundation (building) area excavated to near sub -grade evaluation". I suggest that a soils engineer re-evaluate the site for compaction and movement characteristics. Floor Plan & Structural Deficiencies: 1) The floor plan does not match the approved plan. The garage on the floor plan is level with the house. The garage was built 12" lower than the house and a concrete step was installed for access. The stair was placed in the middle of the exterior Garage door landing and does not comply with Section R311.3. The door should have been moved over to accommodate the required landing. 2) Attic access is required in the garage and was not installed. This should have been pointed out on final inspection. 3) Truss design appears to be adequate however they appear to be missing hold down devices required for uplift. This is a problem and may be in part responsible for some of the drywall failures. 4) Roof sheathing has been installed incorrectly. The installation does not allow for the needed space between the panels for expansion. This is a huge issue for a structure of this size. See "Document 2B". 5) The city did not require engineering for this structure and I question the overall engineering in regards to shear & rotational forces. Mr. Kahn would need to hire an engineer to verify. 6) Other Items that do not appear meet their installation standards include: Windows Siding &Flashing Exhaust Venting Drywall & Painting From Yelp 2/4/2018 …We do not appreciate the water pooling at the side of our house and in our backyard very close to our house foundation. Although our Hayden representative (changed 3 times in 6 months) keeps saying we have nothing to be concerned about and they cannot grade until Spring, we are very concerned and unsatisfied about the growing huge ponds (plural) of water in our backyard and house side with water likely to seep into our crawl space. All of the other houses do not have water pooling when having a decent rough grade. Unfortunately, our exterior paint touch ups, front yard, and the re-do of our driveway needs to take place in the Spring. Additionally, cold air is seeping into our house through our front door and laundry door. Changing options in the middle of the process, flipping floor plans, restrictions on colors, forcing full landscaping then misrepresenting how it will be done, pricey upgrades for everything, no flexiblity and no concern for the buyer at all. Their way or the highway. You can't even talk to the builder, you must go through your realtor who will contact their realtor. And then it's always, "well, the city said we have to do this", which has proven to be just an excuse. They really don't care if you're happy or not. They have your deposit and if you walk, someone will buy your lot in one day and they know it. I'd never recommend them or build with them again. The only reason I went with them in the first place was the location of the neighborhood. I should have went with New Tradition or another builder and sacrificed the location by a few miles.
