Gabi sells low-quality shoes, the price of which in the store can be up to 5-10 times higher than the cost of the shoes, because : For the first time, I encounter a situation where when buying men's shoes, within 3 weeks after wearing them, the sole of the heel broke, and the sole of the sole came open when it was broken and it was simply unrealistic to repair them. It should be noted that the shoe did not undergo any sporting activities or exploitation in extreme conditions. Despite the fact that I brought the shoes back to the store and the sellers promised to examine them as soon as possible and inform me of the decision within the next two days, I would not receive it if I did not call myself next week. It turns out that the store does not call the customer better, but makes the desired decision and using the statutory time of 10 days to provide written answers on the decision regarding the claim in the application, thus distancing itself from any further contact with such customers. It should be noted that the seller tore the sole of the shoes in the on-site store and on the spot after a telephone conversation, possibly with the boss, speaking in foreign, could understand that the shoes could be a defect. As the shoes were not an expensive purchase and their material was mostly dominated by faux leather, at the end of the working day they were noticeably slightly damp, because there had been rain outside and such material easily absorbs it. I was almost ready to exchange unexpectedly broken shoes for others, even at an additional cost, but this scenario deterred me from doing so because: 1) the attitude and promises of the staff of the "Gabi" store work only as long as the store is able to withdraw money from the buyer ; 2) regardless of the amount for which the shoes have been purchased, contesting the occurrence of their premature defects using the store's own expert will be a futile measure in the interests of the store itself; 3) notwithstanding that in accordance with Cabinet Regulation No. 631 "Procedure for filing and reviewing a consumer's claim for a non-compliant product or service" I exercise the right to make a claim to the seller, according to the decision explained by the Gabi store seller by phone - the shoes are worn out of weather (despite the fact that they are autumn shoes). When asked whether such shoes did not correspond to the season, it was reported that in the autumn changing weather conditions, especially when the outside is increasingly humid, rubber boots are provided for such conditions alone. Taking into account that it is not possible for me to be sure how the seller has complied with the Cabinet Regulation No. of 1 August 2006. 631 "Procedure for filing and examining a consumer's claim for a non-compliant product or service", then, given that the decision is negative, I have to exercise my right to complain to the Consumer Protection Center or settle for what happened and buy the next shoes, hopefully not for 3 weeks.
